St Albans is an affluent Roman City in Hertfordshire with the famous St Albans Abbey at it’s centre. Point 1.
By reason of scale, mass, bulk, proximity to boundaries and siting the proposed development would represent a poor quality of design that would be harmful to the character and appearance of the local area. Particular harm is caused through the contrived roof form of the proposed development with its variety of heights and its flat roof element to accommodate the roof terrace which is not characteristic of the local area, and the varying depths and materials used on the elevations (particularly when viewed from London Road) which fail to provide a coherent overall appearance of the proposed development. The proposed development is therefore contrary to Policy 69 (General Design and Layout) and Policy 70 (Design and Layout of New Housing) of the St Albans District Local Plan Review 1994 and the National Planning Policy Framework 2018.
Point 2.
By reason of the its scale, mass, bulk and siting to the south of no.224A the proposed development would adversely impact upon the living conditions of the occupants of no.224A London Road, through infringing the outlook afforded to occupants of this property, loss of daylight and sunlight and increasing the amount of overshadowing in this property’s garden. Moreover, the proposed roof terrace, particularly in the absence of any privacy screening, would fail to preserve the privacy of neighbouring occupants at no.224A and no.228 London Road. The proposed development would therefore be harmful to the amenities of neighbouring occupiers and fail to accord with Policy 70 (General Design and Layout) of the St Albans District Local Plan Review 1994 and the National Planning Policy Framework 2018.
Point 3.
The application site’s south western boundary is shared with Network Rail. Network Rail convey permitted development rights to undertake a wide array of works pursuant to the operation of the railway, over which the Local Planning Authority has very limited control. The proposed development is sited in very close proximity to this boundary and habitable windows in the ground floor of Flat 2 as denoted on the submitted plans. In this context, it has not been demonstrated to the satisfaction of the Local Planning Authority that Flat 2 would be afforded sufficient outlook or other such residential amenity in perpetuity, and consequently the proposed development is therefore unacceptable in terms of its impact on the amenities of future occupiers. The proposed development is therefore contrary to Policy 70 (General Design and Layout) of the St Albans District Local Plan Review 1994 and the National Planning Policy Framework 2018
